Terms & Conditions for Parents
1. Definitions
App / Platform: the Soghari app and its associated website. The Company / We: the management of the Soghari app. Parent / User: the father, mother, or legal guardian responsible for the child and registered on the app. Nursery / Centre: licensed childcare houses and daycare centres registered on the platform to offer their services.
2. The app's role
Soghari is an intermediary technology platform connecting parents with licensed nurseries in Saudi Arabia. The app facilitates search, registration, communication, and daily follow-up; it is not an operator of the nurseries and is not directly responsible for the actual care of children inside those centres.
3. Account creation & data security
The parent undertakes to provide true, accurate, and up-to-date information at registration (such as full name, mobile number, national ID / Iqama, and the child's health and medical data). The parent is fully responsible for keeping login credentials (username and password) confidential and for any activity carried out through their account. The parent must update any change to their data immediately, particularly emergency contact numbers or the child's health status.
4. Registration & nursery admission
A child's admission to any nursery is subject to that nursery's own terms and conditions, as well as seat availability. Completing a booking or paying fees through the app is an initial request that becomes final only after the relevant nursery confirms and approves it.
5. Payments & fees
Nursery fees or subscriptions are paid through the secure, approved electronic payment channels within the app. Refund and cancellation policies are set by each nursery individually and shown on the nursery's page before payment is completed, with the app committed to the applicable local consumer-protection regulations.
6. Personal data & privacy
We place the highest importance on the privacy of your data and your children's data. Personal, health, and visual data (daily photos and videos) are collected and processed in accordance with Soghari's Privacy Policy, which complies with the Kingdom's Personal Data Protection Law. The parent consents to sharing the child's necessary data (such as allergies, special needs, and emergency contact details) with the nursery they register with to ensure safe care.
7. Legal liability & emergencies
Full responsibility for the child's safety, education quality, health care, and nutrition inside the nursery rests with the operating Nursery / Centre, in accordance with the licences issued to it by the relevant government authorities. In medical emergencies, the parent grants the nursery and the app the right to take initial first-aid measures and to contact the competent medical authorities or the emergency contacts specified in the account.
8. Acceptable conduct & use
The parent undertakes to use the app's communication channels (chats, ratings, comments) in a professional and courteous manner; any abusive language or mistreatment of app staff or nursery personnel is strictly prohibited. The app reserves the right to ban or cancel the account of any user who violates acceptable-conduct standards, with no financial or legal liability toward them.
9. Amendments to the terms
Soghari reserves the right to update or amend these Terms at any time to ensure regulatory compliance or to improve services. Parents will be notified of any material amendments through the app or by email, and continued use of the app after the amendment constitutes implied acceptance of it.
10. Governing law & dispute resolution
These Terms are governed by and interpreted in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia. Should any dispute arise relating to use of the app, the parties shall seek to resolve it amicably; failing that, jurisdiction lies with the competent courts in the city of Riyadh.
Terms & Conditions for Nurseries & Childcare Centres
1. Eligibility & government licences
The nursery represents that it is a legally established entity holding all valid licences and commercial registrations issued by the relevant government authorities in Saudi Arabia (such as the Ministry of Human Resources and Social Development and the Ministry of Commerce). The nursery bears full legal responsibility for any violations or revocation of its official licences and undertakes to notify the app immediately of any change to its legal status.
2. Nature of service & limits of liability
Soghari's role is limited to being an intermediary technology platform providing marketing, electronic matching, and the facilitation of bookings and payments between parents and nurseries. The app does not intervene in actual supervision, daily operation, care quality, or child safety inside the nursery. Full responsibility for physical safety, health care, nutrition, and education rests with the nursery alone.
3. Accuracy of data & digital content
The nursery undertakes to provide accurate, correct information about its capacity, prices, features, and geographic location via its control panel. The nursery is responsible for the quality and accuracy of the visual materials and texts uploaded to its page on the app, and undertakes not to infringe any third party's intellectual property rights.
4. Financial policy & fees
The nursery agrees to pay the platform subscription fee and the booking commission according to the rates set out in the commercial agreement and the approved pricing shown at registration. The app reserves the right to review and adjust these fees in the future, provided the nursery is notified at least 30 days before any change takes effect.
5. Payment cycle & settlement
Parents' fees are collected through the approved electronic payment channels in the app. Amounts due to the nursery are transferred after deducting the platform fees (commission) and any applicable administrative or banking charges, on a regular periodic basis according to the platform's approved settlement schedule, and provided the nursery supplies the app with the official bank account (IBAN) matching the entity's name.
6. Cancellation & refund policy
The nursery undertakes to define a clear, published policy for booking cancellations and refunds for parents and to display it on its page in the app. In the event of a dispute between a parent and the nursery over a refund, the nursery undertakes to resolve it amicably in line with the Kingdom's consumer-protection regulations, and the app bears no financial liability arising from such disputes.
7. Confidentiality & personal-data protection
The nursery strictly complies with the Personal Data Protection Law issued in Saudi Arabia. Using parents' or children's data available through the app for any purpose outside the scope of providing the care service (such as selling data, external promotion, or sharing it with third parties without permission) is strictly prohibited. The nursery also undertakes to obtain the necessary written or electronic consents from parents before photographing children or sharing their visual daily updates through the app.
8. Service quality & ratings
The nursery is subject to a direct rating system by parents through the app. Soghari reserves the right to suspend or close any nursery's account temporarily or permanently in the event of repeated serious complaints against it, a marked drop in ratings, or misuse of the platform, in order to protect children's safety and the app's reliability.
9. Amendments to the terms
Soghari may update these Terms at any time to meet regulatory or technical requirements. Subscribed nurseries will be notified of new amendments, and continued use of the control panel and the app is considered full acceptance of the updates.
10. Governing law
This agreement is governed by the laws and regulations in force in the Kingdom of Saudi Arabia, and the courts of the city of Riyadh have jurisdiction over any dispute arising regarding its interpretation or execution.
